05/03/2002Order/ProceduralFiled Order. Order Granting Stay and Remanding for Limited Purpose of Determining Supersedeas Bond Amount. Appellant has moved to stay enforcement of the Judgment,as well as enforcement of a subsequent order awarding respondent attorney fees. Because appellant has not yet appealed from the order granting attorney fees, we deny the motion to the extent that it seeks to stay enforcement of the order granting attorney fees. We grant appellant's motion with respect to the judgment upon jury verdict and hereby stay the district court's March 25, 2002, judgment with all enforcement proceedings of that judgment pending further order of this court. In addition, we remand this matter to the district court for the limited purpose of determining the amount of the bond. The district court shall determine the amount of the bond within 15 days of the date of this order. Appellant shall then have 15 days to post the bond and to submit proof to this court that the bond has been posted. Appellant's failure to comply with the bond condition will result in this court's vacation of the stay. 02-07854

More than 40 days have passed since our order was issued, and appellant has not submitted any proof of posting the bond.
