11/08/2005ORDER It appearing that the court has received a certified copy of an order of the Court of Appeals of Maryland imposing disbarment by consent on respondent, it is accordingly, pursuant to D.C. Bar Rule XI, Sec 11 (d), ORDERED that respondent is suspended from the practice of law in the District of Columbia pending final disposition of this proceeding, effective on the entry date of this order, and it is FURTHER ORDERED that Bar Counsel inform the Board on Professional Responsibility of its position regarding reciprocal discipline within 30 days of the date of this order. Thereafter, respondent shall show cause before the Board on Professional Responsibility, if cause there be, within 10 days why identical, greater or lesser discipline should not be imposed in the District of Columbia. It is FURTHER ORDERED that the Board on Professional is directed to recommend promptly thereafter to this court whether identical, greater or lesser discipline should be imposed as reciprocal or whether the Board instead elects to proceed de novo pursuant to D.C. Bar Rule XI, Sec 11. It is FURTHER ORDERED that the Clerk shall cause a copy of this order and the order of the Court of Appeals of Maryland to be directed to the Chair of the Board on Professional Responsibility and transmitted to respondent. It is FURTHER ORDERED that respondent's attention is drawn to the requirements of D.C. Bar Rule XI, Sec 14 relating to suspended attorneys and to the provisions of Sec 16 (c) dealing with the timing of eligibility for reinstatement as related to compliance with Sec 14, including the filing of the required affidavit. It is FURTHER ORDERED that Bar Counsel advise the court if the matter is concluded without the necessity for further court action. (ETW)

12/08/2005REPORT AND RECOMMENDATION OF BOARD ON PROF. RESP. that the reciprocal discipline matter be dismissed as moot, without prejudice to Bar Counsel's reinstating a reciprocal discipline proceeding if respondent seeks reinstatement to the District of Columbia Bar while his Maryland disbarment is still in effect. The Board further recommends that for purposes of reinstatement, the disbarment run nunc pro tunc to August 8, 2005, the date of respondent's disbarment in Maryland. Bar Counsel supports nunc pro tunc treatment of the disbarment, based on respondent's notification to Bar Counsel of his Maryland discipline and his compliance with the requirements of D.C. Bar R. XI, Sec 14 (g) and Goldberg.

12/29/2005FiledDISBARRED ON CONSENT On consideration of the affidavit of Thomas P. Liniak, wherein he consents to disbarment from the Bar of the District of Columbia pursuant to Sec 12 of Rule XI of the Rules Governing the Bar of the District of Columbia, which affidavit has been filed with the Clerk of this court, the report and recommendation of the Board on Professional Responsibility with respect thereto, and the letter from the Office of Bar Counsel dated December 14, 2005, advising the court that Bar Counsel does not not an exception to the report and recommendation of the Board on Professional Responsibility, it is this 29th day of December, 2005 ORDERED that the said Thomas P. Liniak, is hereby disbarred by consent effective forthwith. The effective date of respondent's disbarment shall run, for reinstatement purposes, nunc pro tunc to August 8, 2005, the date of respondent's disbarment in Maryland. It is FURTHER ORDERED that the reciprocal matter be dismissed as moot without prejudice to the Bar Counsel reinstating a reciprocal discipline based proceeding if respondent seeks reinstatement to the District of Columbia Bar while his Maryland disbarment is still in effect. The Clerk shall publish this order, but the affidavit shall not be publicly disclosed or otherwise made available except upon order of the Court or upon written consent of the respondent. The Clerk shall cause a copy of this order to be transmitted to the Chairman of the Board on Professional Responsibility and to the respondent, thereby giving him notice of the provisions of Rule XI, Sec 14 (g), with which respondent appears to have complied, and Sec 16, which set forth certain rights and responsibilities of disbarred attorneys and the effect of failure to comply therewith.
