The motion was served by mail on appellant on September 7, 2004. To date, appellant has not opposed or otherwise responded to the motion. Cause appearing, we grant Mr. Ranalli's motion in part, and allow him to withdraw as counsel of record for appellant. The clerk shall remove Mr. Ranalli and the law firm of Ashby & Ranalli, LLP, as counsel of record for appellant. However, we deny Mr. Ranalli's motion to the extent that it seeks to indefinitely stay this appeal until appellant has retained new counsel. Appellant shall have 60 days from the date of this order to retain new counsel and cause counsel to file a notice of appearance with this court. If appellant does not intend to obtain new counsel, he shall so inform this court in writing within the same time period. We caution appellant that failure to retain new counsel will result in this appeal proceeding as a proper person appeal. See NRAP 46(b). fn1[We vacate our July 27, 2004, order that directed appellant to file the docketing statement and request transcripts in compliance with NRAP 9(a).
