Presently before the court is Byrd's motion to dismiss this appeal as premature, or alternatively, 'to stay this matter so that all claims of all parties in the District Court cases may be resolved.' Also before the court is Byrd's motion to supplement the record. The district court's January 21, 2003 order resolved Byrd's counterclaim, and constitutes the final judgment in this case. Consequently, this appeal is not premature. We, therefore, deny the motion to dismiss or stay. We conclude that our resolution of this appeal will be assisted by reviewing plaintiff's exhibit five and defendant's exhibit eight, which were admitted by the district court in Case No. CV02-01132 on March 4, 2002. We direct the district court clerk to transmit those exhibits to the clerk of this court. fn3[To the extent that appellant's motion to review all exhibits seeks to supplement the record with exhibits not included in the record on appeal, the motion is denied without prejudice.
