06/17/2005Order/ProceduralFiled Order. Directing Answer and Granting a Temporary Stay. Having reviewed the petition, it appears that petitioner has set forth issues of arguable merit and that petitioner may have no plain, speedy and adequate remedy in the ordinary course of the law. Therefore, Judge Hardcastle shall have thirty days from the date of this order within which to file an answer, including authorities, against issuance of the requested writ. In particular, the answer should address whether the district court's order to show cause was properly issued after petitioner had allegedly paid the necessary filing fees in Case No. A500914. We temporarily stay the district court contempt hearing, scheduled for July 11, 2005, pending our receipt and consideration of the answer. Fn 2[On January 25, 2001, petitioner was granted in forma pauperis status in District Court Case No. 429810, from which the district court's show cause order and this proceeding arise. As the district court's January 25 order appears still in effect, the fee to file this writ petition has been waived. See NRAP 21(e). Accordingly, petitioner's June 15, 2005 application to waive fees is denied as moot.] 05-11949
