Appellant has moved for a second extension of time to file and serve the opening brief and appendix. In support of the motion, counsel for appellant represents that she is awaiting the transcripts for 'voir dire, jury selection.' Consequently, appellant requests 30 days 'after receipt' of the transcripts to file and serve the opening brief. Attached to the motion is a request for rough draft transcripts that was filed in the district court on October 5, 2004, requesting the transcripts of the December 9, 2003, and December 10, 2003, voir dire and jury selection proceedings. That same transcript request form was filed in this court on October 12, 2004 Cause appearing, we grant the motion in part. Appellant shall have 50 days from the date of this order to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). Appellant has submitted a proper person motion for leave to file the opening brief and a proper person motion for an extension of time to file the opening brief. Because appellant is represented by counsel, we deny his motion for leave to file the opening brief. We further we deny as moot appellant's motion for an extension of time to file the opening brief.
