On November 30, 2001, appellant's counsel, attorney Robert Bruce Lindsay, filed a "Motion to Withdraw as Attorney of Record for Appellant and Request to have Sanctions Set Aside. We grant the motion. We remand this appeal for the limited purpose of securing counsel for appellant. If indigent, the district court shall have 30 days from the date of this order to appoint counsel for appellant. Otherwise, the district court shall order that, within 30 days, appellant must retain counsel and counsel must enter an appearance in the district court. Within 5 days of appointment or counsel or of retained counsel's entering an appearance with the district court, the district court clerk shall: (1) transmit to this court, a copy of the district court's written or minute order; and (2) serve a copy of this order on new counsel. Thereafter, new counsel shall have 10 days to file a notice of appearance with the clerk of this court. New counsel shall have 15 days from the filing of the notice of appearance to file and serve a docketing statement and shall have 90 days to file and serve the opening brief and appendix. Briefing shall proceed in accordance with NRAP 31(a)(1). In his November 30, 2001, motion to withdraw, Mr. Lindsay also requests an extension of time to pay the sanctions. fn1[Although the title of the motion includes a 'Request to Have Sanctions Set Aside,' the body of the motion requests an extension of time to pay the sanctions.] We have reconsidered the monetary sanctions imposed in this appeal in light of Mr. Lindsay's indications that they may pose a financial hardship. Under the circumstances, we conclude that the monetary sanctions should be vacated. We vacate that portion of our November 28, 2001, order imposing sanctions of $500.00 on Mr. Lindsay. 02-13144
