When our preliminary review of the docketing statements and the documents submitted to this court pursuant to NRAP 3(e) revealed a potential jurisdictional defect, we directed appellant Raymond Buxsel and cross-appellant Mandalay Corporation to show cause why this appeal and cross-appeal should not be dismissed. We conclude that resolution of the jurisdictional issue presented in this matter is governed by a case cited by neither Buxsel nor Mandalay. In Paul v. Pool, we held that '[t]he answer of a co-defendant inures to the benefit of a defaulting defendant where there exists, as here, a common defense as to both of them.' Here, Mandalay and McMaster shared the common defense that Buxsel's claims against them were barred by Nevada's workers' compensation laws. We thus conclude that Mandalay's answer and the summary judgment in Mandalay's favor inure to McMaster's benefit, and render the district court's order a final judgment. Accordingly, this appeal shall be permitted to proceed. 04-08478

On June 26, 2003, this court entered an order directing appellant/cross-respondent ('appellant') and respondent/cross-appellant ('respondent') to each request transcripts in compliance with NRAP 9(a). To date, respondent has not complied with our order. Our cursory review of respondent's brief indicates that respondent only cited to the January 7, 2003, transcript, which was filed in this court on April 28, 2003. Accordingly, we conclude that this court has the transcript necessary to resolve this appeal and cross-appeal and we waive respondent's requirement to request transcripts in compliance with NRAP 9(a). 04-10089
