On August 11, 2003, counsel for respondents filed a letter informing this court that appellant is the subject on an involuntary bankruptcy petition, and that it appears this appeal should be stayed. Appellant was the defendant below. Accordingly, this appeal is stayed pending further order of this court. Because this appeal remains on this court's active docket, however, counsel for appellant shall file a status report within 90 days from the date of this order informing this court of the status of the bankruptcy proceedings and specifically stating whether this appeal is stayed. If counsel reports that this appeal may proceed, counsel shall attach to the report any relevant orders or filings from the bankruptcy proceeding. On July 16, 2003, counsel for appellant, attorney Kevin R. Hansen, filed a motion to withdraw as attorney of record. Because Mr. Hansen has not provided cause for withdrawal, and because the required proof of service has not been provided, we deny the motion. This denial is without prejudice to refilling a motion to withdraw once the bankruptcy stay is lifted. Any such motion shall set forth the circumstances and cause for withdrawal and contain proper proof of service. 03-14812

Our order directed appellant's counsel to file a status report regarding the pending bankruptcy proceedings by December 3, 2003. To date, counsel for appellant has not complied with the order. Because this matter remains on this court's active docket, counsel for appellant shall file a report informing this court of the status of the bankruptcy proceedings within 15 days from the date of this order.
