On November 9, 2004, this court entered a dispositional order affirming the judgments of the district court in these consolidated appeals. On November 18, 2004, respondent filed a memorandum of costs pursuant to NRAP 39 for the amount of $29.50. Incorporated in the memorandum is a request of $9,600.00 in attorney fees pursuant to 'NRAP 38(a) and (b).' NRAP 38 allows this court to award attorney fees and costs when an appeal has been taken frivolously or been processed in a frivolous manner. We conclude that this appeal was neither taken frivolously nor processed in a frivolous matter. We therefore deny appellant's motion for attorney fees and costs. See NRAP 38.
