Accordingly, we consolidate these appeals for all appellate purposes. The settlement judge has further informed this court that the issues on appeal in Docket No. 41594 were addressed in the settlement conference held in Docket No. 41007. Accordingly, the appeal in Docket No. 41594 will not be assigned to the settlement conference program. We reinstate the deadlines for requesting transcripts and filing briefs. See NRAP 16(c). Appellant shall have 15 days from the date of this order to comply with NRAP 9(a). Appellant shall have 120 days from the date of this order to file and serve a single opening brief and appendix, addressing the issues raised in both appeals. 01/21/2005Order/ProceduralFiled Order. Regarding Costs. On November 9, 2004, this court entered a dispositional order affirming the judgments of the district court in these consolidated appeals. On November 18, 2004, respondent filed a memorandum of costs pursuant to NRAP 39 for the amount of $29.50. Incorporated in the memorandum is a request of $9,600.00 in attorney fees pursuant to 'NRAP 38(a) and (b).' NRAP 38 allows this court to award attorney fees and costs when an appeal has been taken frivolously or been processed in a frivolous manner. We conclude that this appeal was neither taken frivolously nor processed in a frivolous matter. We therefore deny appellant's motion for attorney fees and costs. See NRAP 38.
