11/12/2003Order/ProceduralFiled Order Denying Motion. to Disqualify and Denying Motion to Stay Remittitur. On September 18, 2003, this court entered an 'Order Denying Writ Petition.' This court denied the petition for rehearing on October 16, 2003. While the petition for rehearing was pending, the Attorney General's Office filed a notice of appearance on behalf of respondents. Petitioner objects. fn1[We note that petitioner has neither sought nor been granted leave to file documents in proper person in this matter. See NRAP 46(b). Nevertheless, we direct the clerk to file the proper person documents submitted on October 20, 2003; October 22, 2003; October 29, 2003 and November 6, 2003.] Petitioner specifically requests this court to disqualify the Attorney General's Office from representing respondents arguing that respondents 'are not lawfully entitled to such representation.' The Attorney General's Office opposes petitioner's objection and moves this court to deny petitioner's motion to disqualify them. fn2[2We direct the clerk to file the Attorney General's opposition.] Because it appears that the Attorney General's office is statutorily required to represent respondents and because it appears that there is no conflict prohibiting such representation, we deny petitioner's motion to disqualify the Attorney General's Office. Petitioner has submitted a document entitled 'Order to Show Cause.' Based on our review of this document it appears that the document has no relevance to this writ petition. Accordingly, the clerk shall return this document unfiled. Petitioner has submitted a motion to stay issuance of the remittitur pursuant to NRAP 41(b) 'pending application to the Supreme Court of the United States for review.' We elect to treat petitioner's motion as a motion to stay issuance of the notice in lieu of remittitur. No good cause appearing, we deny the motion. The clerk shall issue the notice in lieu of remittitur. See NRAP 41(a). Petitioner has submitted a motion to stay issuance of the remittitur pursuant to NRAP 41(b) 'pending application to the Supreme Court of the United States for review.' We note that because this is an original proceeding before this court, a notice in lieu of remittitur will issue rather than the remittitur. We elect to treat petitioner's motion as a motion to stay issuance of the notice in lieu of remittitur. No good cause appearing, we deny the motion.
