02/13/2004Order/ProceduralFiled Order. Reinstating Briefing and Granting Motion to Withdraw as Counsel. The parties were unable to agree to a settlement. Accordingly, we reinstate the briefing schedule. See NRAP 16(c). On December 8, 2003, counsel for respondent, attorney Michael C. Van, filed a 'Notice of Withdrawal of Counsel.' On the same date, respondent filed a proper person document purporting to substitute herself 'as attorney of record in this action in the place of Michael C. Van, Esq.' We elect to treat Mr. Van's notice as a motion to withdraw, and cause appearing, we grant that motion. The clerk of this court shall remove Mr. Van from this court's docket. Further, we elect to treat respondent's purported substitution of counsel as a notice that she will not be retaining new counsel in this matter. fn1[Because we have considered appellant's proper person document in our resolution of this matter, the clerk shall file that document. We decline, however, to grant respondent permission to file additional proper person documents. See NRAP 46(b).] Appellant shall have 70 days from the date of this order to file and serve the opening brief and appendix. This appeal shall be submitted for decision upon the filing of the opening brief. fn2[If respondent does retain new counsel to represent her in this appeal, she shall cause counsel to enter a notice of appearance and request an amended briefing schedule.] 04-02834
05/06/2004Order/ProceduralFiled Order/Show Cause. Response due from appellant: 30 days from the date of this order. The briefing schedule is suspended pending further order of this court. 04-08433
11/15/2004Order/DispositionalFiled Order Dismissing Appeal. To date, appellant has failed to respond to our May 2004 order to show cause. Because appellant has failed to demonstrate that we have jurisdiction, we "ORDER this appeal DISMISSED." NNP04-NB/DA/MG 04-20858
