When our preliminary review of the docketing statement and the documents submitted to this court pursuant to NRAP 3(e) revealed a potential jurisdictional defect, this court entered an order directing appellant to show cause why this appeal should not be dismissed for lack of jurisdiction. Specifically, it appeared that appellant filed the notice of appeal after the timely filing of a tolling motion and before the tolling motion was formally resolved. See NRAP 4(a)(2). On October 14, 2003, the district court entered an order resolving the tolling motion. On November 13, 2003, appellant filed a timely amended notice of appeal. Accordingly, as the jurisdictional defect has been cured, we reinstate the briefing of this appeal. Appellant shall have 15 days from the date of this order to comply with NRAP 9(a). Appellant shall have 120 days from the date of this order to file and serve the opening brief and appendix. Because respondent is proceeding in proper person, the briefing of this appeal shall be complete upon the filing of the opening brief and appendix. See NRAP 46(b). 03-21095
