03/09/2006DISCIPLINARY LETTER from the Office of Bar Counsel with certified copies of orders issued by the Supreme Court of New York, and the Supreme Court of Nes Jersey suspending respondent from the practice of law for six months. Also, a certified copy of the Certificate of Disposition Indictment is included. Respondent was convicted of Insurance Fraud Fifth Degree Plea.
03/22/2006ORDER On consideration of the certified copies of (1) the Certificate of Disposition Indictment of respondent in the Supreme Court of the State of New York Queens County, (2) the orders of suspension issued by the Supreme Court of the States of New York and New Jersey, it is ORDERED pursuant to D.C. Bar Rule XI, Secs 10 (c) and 11 (d), that respondent, Scott L. Wiss, is suspended from the practice of law in the District of Columbia, effective upon entry of this order, pending final resolution of this proceeding. It is FURTHER ORDERED that the Board on PRofessional Responsibility (the Board) is directed to institute a formal proceeding to determine the nature of the final discipline to be imposed, and specifically to review the elements of the offense for the purpose of determining whether or not the crime involves moral turpitude within the meaning of D.C. Code Sec 11-2503 (a). It is FURTHER ORDERED that the Board is directed to recommend promptly thereafter to this Court whether identical, greater or lesser discipline should be imposed as reciprocal discipline, or whether the Board, instead, elects to proceed de novo pursuant to Rule XI, Sec 11. It is FURTHER ORDERED that respondent direct his attention to the requirements of Rule XI, Sec 14 of the Rules Governing the Bar of the District of Columbia relating to suspended attorneys, and to the provisions of Rule XI, Sec 16 (c) dealing with the timing of eligibility for reinstatement as related to compliance with Rule XI, Sec 14, including the filing of the required affidavit. It is FURTHER ORDERED that Bar Counsel inform the Court if the matter is resolved without the necessity of further court action. (ETW)

03/29/2008REPORT AND RECOMMENDATION OF BOARD ON PROF. RESP. tht the court find that respondent's misdemeanor conviction of insurance fraud in the fifth degree did not involve moral turpitude and that based on his six-month suspension in New York, it impose a reciprocal discipline of a six-month suspension, to be effective, nunc pro tunc, from April 3, 2006, when respondent filed a fully compliant section 14(g) affidavit. Because respondent has been suspended in this jurisdiction by order of the court since March 22, 2006, the Board further recommends that his suspension be deemed fully satisfied upon the Court's entry of a further order in this matter. * Concurring statement by James P.
