06/29/2011ORDER On consideration of the report and recommendation of the Ad Hoc Hearing Committee approving the petition for negotiated discipline, and it appearing that there is a question of whether the negotiated sanction is appropriate in light of this court's other decisions involving similar instances of misconduct, it is ORDERED that the report and recommendation is hereby referred to the Board on Professional Responsibility so that it may provide this court with its views concerning the appropriateness of the negotiated discipline. In considering the appropriateness of the negotiated discipline the Board should review this court's prior holdings in cases involving similar circumstances and determine the extent of respondent's dishonesty and non-compliance during the initial investigation of the disciplinary complaint. It is FURTHER ORDERED that the Board's report and recommendation shall be filed with this court within 60 days from the date of this order. (GL,RD,TE)
