We admonish counsel for appellant for submitting untimely documents, and for failing to file a motion for leave to file untimely documents. To date, appellant has failed to file either a transcript request form or a certificate indicting that no transcript is required. Appellant shall have 10 days from the date of this order to file and serve either a transcript request form or a certificate indicating that no transcripts are required and the opening brief and appendix. 02/22/2002Order/ProceduralFiled Order. On August 3, 2001, respondent filed a "Motion for Order Requiring Appellant to File and Serve Transcript." In an affidavit in support of that motion, counsel for respondent represents that the transcript filed on May 18, 2001, "is a partial transcript which only includes the District Court's oral decision." On May 18, 2001, court reporter Corrie Wolden filed a transcript for proceedings held on June 6, 2000. The transcript only includes that part of the proceedings that began at 4:00 p.m., which is only the District Court's oral pronouncement of its ruling. We grant appellant's motion insofar as it requests relief to obtain a full transcripts. We deny the motion insofar as it requests an order directing appellant to file a transcript. Sunshine Reporting Services shall file and serve the complete transcript of the proceedings held on June 6, 2000, within 15 days from the date of this order. If a full transcript cannot be prepared for some reason, Sunshine Reporting Services shall notify this court in writing within that same time period. On August 7, 2001, appellant filed a motion for an extension of time to September 13, 2001, to file and serve the answering brief. That date having passed, we deny that motion as moot. On September 13, 2001, respondent filed a second motion for an extension of 30 days from "the date the full transcript of the proceedings held in district court is filed with this court." Cause appearing, we grant that motion in part. Respondent shall file and serve the answering brief within 20 days from the date that the complete transcript for the proceedings held on June 6, 2000, is filed in this court. See NRAP 31(a)(2). Thereafter, appellant may file a reply brief if warranted within 10 days from the date of service of the answering brief. 02-03420

03/12/2002Order/ProceduralFiled Order. On February 28, 2002, court reporter Wolden filed a letter with this court in response to the February 22, 2002, order. In that letter, court reporter Wolden states that she "never received a request for the full transcript," and that she had not received the required deposit of $375.00 from appellant. We note that appellant filed a transcript request form on April 12, 2001. In order to resolve any confusion over the requesting of transcripts in this matter, appellant shall, within 10 days from the date of this order, file with this court proof that any required deposit has been paid to Sunshine Court Reporting Services or Corrie Wolden for preparation of the complete transcript for the proceedings held on June 6, 2000. Further, court reporter Wolden shall file and serve that transcript within 20 days from the date of this order. As directed in our February 22, 2002, order, respondent shall file and serve the answering brief within 20 days from the date that the requested transcript is filed in this court. See NRAP 31(a)(2).
