| 10/03/2007 | Order filed. | All appellate briefs filed in this case address the issue of the propriety of the trial court granting a motion for summary judgment and/or summary adjudication (the motion) with respect to the first, second, and third causes of action by Plaintiff and Appellant Naill Azzu against Defendant and Respondent Wilfred Brooks. It appears to this court, however, that the trial court did not rule on the motion with respect to Azzu's claims. Rather, the trial court determined the motion was mooted by the filing of Azzu's first amended complaint. (See clerk's transcript, pp. 379, 525 526.) The first cause of action by Azzu against Brooks, as alleged in the first amended complaint, was resolved by demurrer. (See "Order re Defendant's Demurrer and Motion to Strike Plaintiff Naill Azzu's First Amended Complaint,"filed September 22, 2006.) The second and third causes of action were not asserted by Azzu against Brooks in the first amended complaint, but rather were asserted only by Azzu's wife, Faieza Gorges. (See clerk's transcript, pp. 372 377.) The parties are invited to submit supplemental letter briefs on or before October 22, 2007, advising this court whether the above analysis is correct or incorrect, and why. |
