On February 27, 2002, the state bar filed this petition for reciprocal discipline based on a California discipline order against a John J. Kozlowski, and served Joseph J. Kozlowski, Esq., an attorney licensed in Nevada and Illinois, at his residence in Illinois. The state bar apparently believed that the disciplined California attorney and Joseph J. Kozlowski, Esq., were the same person. The next day the state bar apparently realized it error and filed, by fax, a motion to withdraw the petition. 'The petition shall be deemed withdrawn, as if it had never been filed.' We admonish the state bar for its lack of diligence in investigating this matter, and we direct the state bar and bar counsel to immediately issue a letter of apology to Joseph J. Kozlowski, Esq., and to submit a copy of the letter to this court within ten days. EN BANC. 02-04416
