10/16/2002Order/ProceduralFiled Order. Vacating Sanctions and Granting Extension of Time. On October 3, 2002, Bogan filed a motion to reduce the sanction. This court is not unsympathetic to counsel's medical and financial difficulties. Accordingly, we hereby vacate the $500 sanction previously imposed in our order of September 13, 2002. We admonish attorney Bogan that his failure to comply with this court's rules and orders in the future will not be tolerated and may result in his referral to the State Bar of Nevada for commencement of proceedings pursuant to SCR 117 to determine whether he should be transferred to disability inactive status. Counsel shall have 20 days from the date of this order to file and serve the fast track statement and appendix. 02-17994
01/02/2003Order/CounselFiled Order/Remand for Designation of Counsel. Attorney Robert V. Bogan has failed to respond to our order of October 16, 2002. We therefore refer this matter to the State Bar of Nevada for commencement of proceedings pursuant to SCR 117 to determine whether Bogan should be transferred to disability inactive status. Bar counsel shall, within 90 days of this order, inform this court of the status or results of the investigation and any proceedings in this matter. We further conclude that Bogan's dilatory actions and neglect of his obligations to this court and his client require his removal as counsel of record. We remand this appeal to the district court for the determination of whether appellant is indigent. If appellant is indigent, the district court shall have 30 days to appoint counsel. If appellant is not indigent, the district court shall forthwith inform appellant of its determination. Appellant shall have 30 days to secure new counsel and have counsel enter an appearance with this court. District court clerk shall promptly file with this court either (1) a copy of the written order of appointment of counsel; or (2) a copy of the written or minute order determining that appellant is not indigent. New counsel shall enter an appearance with the clerk of this court within 10 days of the date of appointment or retention; within 10 days of appointment file a transcript request; within 60 days file the fast track statement and appendix.
