11/01/2001Order/ProceduralFiled Order. On March 2, 2001, this court issued a notice directing counsel for Mr. Rogers to file an opening brief within thirty days. The notice cautioned that "if no opening brief is filed, the matter will be submitted for decision on the record without briefing or oral argument." To date Mr. Rogers has failed to file an opening brief. This matter shall stand submitted for decision on the record, without briefing or oral argument, as of the date of this order. fn1[The panel further recommended that Mr. Rogers be placed on probation for one year and that the suspension be stayed during this period.] 01-18278

11/07/2001Order/Dispositional BarFiled Bar Discipline Order. Order Aproving Conditional Guilty Plea in Exchange for Stated Form of Discipline. We conclude that while Rogers' conduct was egregious, the discipline set forth in the panel's recommendation is appropriate in light of the mitigating circumstances. "We suspend Rogers for six months, with the suspension to be stayed, and place Rogers on probation for one year, subject to the conditions recommended by the panel. In addition, Rogers is hereby publicly reprimanded." The panel shall have continuing jurisdiction over Rogers, and any future misconduct shall be grounds for the panel to recommend to this court that the six-month suspension should be imposed.
