12/21/2001Order/ProceduralFiled Order. Order Staying Appeal. On August 3, 2001, appellant filed a 'Notice of Bankruptcy Filing.' Consequently, an appeal is subject to the automatic bankruptcy stay if the debtor was the defendant in the underlying trial court action. Appellant Kasson L. Cornella was the defendant in the proceedings below. Accordingly, this appeal is stayed pursuant to the mandatory stay provisions of federal bankruptcy law. On November 30, 2001, attorney Patrick M. Hunter submitted a letter to this court regarding the effect of the bankruptcy stay on the assignment of this appeal to the settlement program. It appears that Mr. Hunter represents appellant in the bankruptcy proceedings in Wyoming. In the letter, Mr. Hunter states that the appellant wishes to 'contest the finding of [the settlement judge]' as presented in the Settlement Conference Report filed on November 6, 2001. No action will be taken with regard to that letter, however, as any request for relief must be made by filing a formal motion that is signed by the attorney of record. Further, as this matter is stayed, we decline, at this time, to act on the Settlement Judge's recommendations made in the Settlement Conference Report. Finally, because this matter remains on this court's docket, counsel of record for appellant, attorney Jonathan King, shall file a report informing this court of the status of the bankruptcy proceedings within 90 days from the date of this order. 01-21542
