On July 12, 2001 and August 13, 2001, the settlement judge filed reports recommending the imposition of sanctions against respondent/cross-appellant Tom Wesley Westmoreland for bad faith participation in the settlement conference program. Respondent has filed an opposition to the recommendation. Respondent states that he has given his counsel new settlement authority and that a new settlement offer has been made. Additionally, respondent requests that this matter be reassigned to a different settlement judge and rescheduled for a settlement conference. Because it appears that respondent is currently willing to participate in the settlement conference process in good faith, we defer ruling on the recommendation of sanctions. We deny respondent's request to reassign this matter to a new settlement judge. Any request for settlement judge recusal must be directed to the settlement judge, and the decision to recuse is within the settlement judge's discretion. Settlement Judge Larry Cohen shall have 30 days from the date of this order to schedule a settlement conference. If a request for recusal of the settlement judge is made and granted, the settlement judge shall immediately inform this court.On July 10, 2001, attorney Douglas C. Crawford filed a motion to withdraw as counsel of record for respondent. In light of statements made in the subsequent opposition filed by Mr. Crawford on behalf of respondent, it appears that Mr. Crawford intends to continue as counsel of record for respondent. If this court is in error, and Mr. Crawford still wishes to withdraw, he shall so inform this court in writing within 10 days from the date of this order. 02-02125
