On August 17, 2001, appellant/cross-respondent Calico Ridge Owner's Association ('Calico Ridge') filed a motion, pursuant to NRAP 16(f), for an order to show cause why respondent/cross-appellant Melvin Bagley and his counsel should not be held in contempt, and a motion for sanctions for bad faith participation in the settlement conference proceedings. See NRAP 16(f). fn1[Calico Ridge subsequently filed a motion to file supplemental exhibits and authorities. Cause appearing, we grant the motion. The clerk of this court shall file the supplemental exhibits and authorities received on January 14, 2002.] Mr. Bagley filed an opposition. Appellant's reliance on NRAP 16 is misplaced. Under this rule, the settlement judge must initially make a determination of bad faith participation in the settlement conference process before this court will consider an appropriate sanction. Here, the settlement judge neither determined that Mr. Bagley and his counsel failed to participate in good faith in the settlement conference nor recommended that sanctions be imposed. Because this appeal was dismissed on May 24, 2001, this court no longer retains jurisdiction over this matter. Accordingly, Calico Ridge must seek relief in the district court.
