The opening brief and appendix contained many of the same deficiencies as the brief that was stricken by way of our order entered on October 11, 1999. On December 3, 1999, respondent filed a motion to dismiss appeal and for sanctions. We deny respondent's motion to dismiss appellant's appeal. Because the deficiencies in appellant's opening brief and appendix did not hinder respondent from preparing and filing a combined answering brief and opening brief on cross-appeal, we decline to again strike the opening brief and appendix. fn2[The answering brief was not accompanied by a respondent's appendix. Respondent shall have 10 days from the date of this order to file and serve the Respondent's Appendix.] We do not condone the failure of appellant's counsel to comply with our order entered on October 11, 1999, and the Nevada Rules of Appellate Procedure, and we conclude that the imposition of sanctions is warranted. Attorney Stone shall personally pay the sum of $250 to respondent's counsel to help defray the costs in filing the motion to dismiss appeal and for sanctions. Attorney Stone shall file an affidavit or certificate of payment with the clerk of this court within fifteen (15) days from the date of this order. Appellant shall have 20 days from the date of this order to file and serve a combined reply brief and answering brief on cross-appeal.
