Filed Order on August 17, 1999, respondent/cross-appellant filed a motion to dismiss the appeal of Larry Lloyd Hansen, or in the alternative to sanction appellant's counsel. We strike appellant's opening brief. Appellant shall, within 10 days from the date of this order, serve and file an opening brief and appendix. The opening brief shall be indentical to the stricken opening brief, but the newly filed opening brief and appendix shall comply in all respects with NRAP 28, 30 and 32. We deny respondent's motion filed on August 17, 1999. Nevertheless, we caution that failure to comply with this order in a timely manner and to submit an acceptable opening brief and appendix may result in the immediate imposition of sanctions against appellant's counsel. 08/15/2000 | Order/Procedural | Filed Order. Appellant submitted a new opening brief and appendix on October 21, 1999. The opening brief and appendix contained many of the same deficiencies as the brief that was stricken by way of our order entered on October 11, 1999. On December 3, 1999, respondent filed a motion to dismiss appeal and for sanctions.
We deny respondent's motion to dismiss appellant's appeal. Because the deficiencies in appellant's opening brief and appendix did not hinder respondent from preparing and filing a combined answering brief and opening brief on cross-appeal, we decline to again strike the opening brief and appendix. fn2[The answering brief was not accompanied by a respondent's appendix. Respondent shall have 10 days from the date of this order to file and serve the Respondent's Appendix.] We do not condone the failure of appellant's counsel to comply with our order entered on October 11, 1999, and the Nevada Rules of Appellate Procedure, and we conclude that the imposition of sanctions is warranted. Attorney Stone shall personally pay the sum of $250 to respondent's counsel to help defray the costs in filing the motion to dismiss appeal and for sanctions. Attorney Stone shall file an affidavit or certificate of payment with the clerk of this court within fifteen (15) days from the date of this order. Appellant shall have 20 days from the date of this order to file and serve a combined reply brief and answering brief on cross-appeal. Thereafter, respondent shall have 30 days to file a reply brief on cross-appeal. We caution counsel for appellant that failure to fully comply with this order in a timely manner may result in dismissal of appellant's appeal and the imposition of additional sanctions. | | 00-14219 |

08/22/2000 | Order/Procedural | Filed Order. We vacate the portion of our order entered on August 15, 2000, directing respondent to serve and file the respondent's appendix. [fn1] A review of the record in this matter indicates that although the respondent's appendix was filed on September 2, 1999, an appropriate docket entry was inadvertently not made. | | 00-14674 |

Stone, former counsel for appellant/cross-respondent Larry Lloyd Hansen, to disability inactive status. As of that date, Mr. Stone was prohibited from representing Mr. Hansen in this appeal. To date, Mr. Hansen has failed to cause new counsel to enter an appearance on his behalf. We conclude that Mr. Hansen will be proceeding in proper person.
