12/10/2001Settlement Order/ProceduralFiled Order: No Settlement/Briefing Reinstated. On June 21, 2001, appellant filed a motion for sanctions on the ground that respondent failed to participate in good faith in the settlement process. Appellant requests sanctions in the amount of $1,750. Mr. Lawton filed an opposition. The settlement judge determined that Mr. Lawton's failure to comply with the rules contributed to a non-settlement of this matter. We conclude that Mr. Lawton's cavalier disregard of the requirements under NRAP 16 constitutes a failure to participate in good faith in the settlement conference process and that such conduct warrants the imposition of sanctions. Mr. Lawton shall personally pay appellant $1,750 as reimbursement for attorney fees and costs incurred in preparing for and attending the conference. Within 20 days of the date of this order, Mr. Lawton shall file with the clerk of this court an affidavit or certificate verifying that payment has been made. Failure to comply with this order in a timely manner may result in the imposition of additional sanctions. On May 23, 2001, attorney Jonathon H. King filed a motion to withdraw as counsel for appellant. Mr. King's motion does not provide any information regarding whether he provided appellant reasonable warning that he would withdraw unless she paid for services rendered. Cause appearing, we deny Mr. King's motion. appellant shall have 10 days from the date of this order to file the docketing statement or show cause why sanctions should not be imposed. Appellant shall have 15 days from the date of this order to file a transcript request form or certificate of no transcript. request. Because this is a child custody matter, appellant shall have 90 days from the date of this order to file and serve the opening brief and appendix. Respondent shall have 20 days after service of the opening brief to file and serve the answering brief. Appellant shall have 10 days after service of the answering brief to file and serve the reply brief. (Docketing statement mailed to counsel for appellant). 01-20651

02/14/2002Order/ProceduralFiled Order. On December 31, 2001, Jonathan H. King filed a motion to withdraw as counsel of record for appellant. To date, appellant has not opposed the motion, or otherwise responded to the motion. We grant the motion. Appellant shall have 30 days from the date of this order to retain new counsel and cause counsel to file a notice of appearance with this court. if appellant does not wish to pursue this appeal, she shall so inform this court in writing within the same time period. Failure to respond to this order may result in this appeal proceeding as a proper person appeal. Briefing and compliance with NRAP 9(a) are suspended until further notice by this court. On January 3, 2002, Mr. King filed a 'Motion for Order Establishing, Adjudicating and Enforcing Lien.' On January 16, 2002, Mr. King filed a 'Notice of Withdrawal of Motion.' Because Mr. King withdraws his motion, we conclude that a ruling on that motion is not warranted. 02-02923
