On January 7, 2002, respondent filed an opposition to appellant's motion. On January 14, 2002, appellant filed a motion for permission to file a reply to the opposition. Cause appearing, we grant that motion. The clerk of this court shall file the proposed reply received on January 14, 2002, that was attached to the motion. Appellant filed a timely notice of appeal challenging that part of the district court order that granted the petition for judicial review and reversed the appeals officer's decision concerning the proper averaging period and remanded for recalculation using a 12-week period. Accordingly, only that part of the district court order is the subject of this appeal. Respondent has not filed a notice of appeal or cross-appeal challenging that portion of the district court order that denied the petition for judicial review of the appeals officer's decision regarding concurrent wage information. Thus, it was improper for respondent to raise arguments regarding that issue in the answering brief. Accordingly, we grant appellant's motion, in part. In taking this appeal under submission, this court shall disregard the following portions of the answering brief which discuss the issue regarding concurrent wages: lines 15-22 on page 2; lines 14-23 on page 3; lines 3-18 on page 4; lines 3-7 and 13-14 on page 5; lines 22-24 on page 10; lines 1-4 and 16-26 on page 11; all of pages 12-14; lines 1-12 and 24-17 on page 15; and lines 1-4 on page 16. 02-05161
