On August 13, 1998, we ordered appellant's counsel, Gayle Nathan, to show cause why we should not dismiss the appeal for appellant's failure to appear at the scheduled settlement conference and pursuant to the settlement judge's bad faith determination. On August 25, 1998, attorney Nathan filed a response. As it appears that appellant did not deliberately fail to attend the scheduled settlement conference, we conclude that sanctions are unwarranted. The settlement judge shall have 30 days from this order to schedule this matter for another settlement conference. We admonish attorney Nathan to ensure her client's attendance at the next scheduled settlement conference.
