12/01/2010GRANTED On consideration of the motion of the Board on Professional Responsibility filed pursuant to D.C. Bar R. XI, Sec 15 to appoint a member of the District of Columbia Bar to protect the interests of the clients of Carol L. Matthews, who has been suspended based on disability pursuant to D.C. Bar R. XI, Sec 13, and it appearing that such appointment is necessary because there is not partner, associate, or other responsible attorney capable of conducting the attorney's affairs, it is hereby ORDERED that Daniel Schumack, Esquire, is appointed to inventory the files of respondent, a member of the District of Columbia Bar, to make appropriate disposition of such files, to properly distribute any client funds in the attorney's escrow accounts if possible, and to taken any other appropriate action to ensure continuity of the representation for the attorney's clients; and it is FURTHER ORDERED that Mr. Schumack shall file with the Board written acceptance of this appointment; and it is FURTHER ORDERED that as promptly as possible, Mr. Schumack shall provide the Executive Attorney of the Board a written estimate of the number of hours necessary to complete the inventory and distribution of the client files, and that Mr. Schumack shall submit to the Executive Attorney monthly statements of the time spent and expenses incurred in carrying out this appointment; and it is FURTHER ORDERED that Mr. Schumack shall be compensated by the Board for the services rendered in carrying out the appointment at the prevailing rate under the District of Columbia Criminal Justice Act without prejudice to the Board seeking reimbursement from any appropriate parties; and it is FURTHER ORDERED that should Mr. Schumack determine, after conducting an inventory of the files, that additional assistance is required to carry out his responsibilities pursuant to this order, that Mr. Schumack shall notify the Board, which may, in its discretion, appoint an additional attorney or attorneys to protect the interests of the clients pursuant to D.C. Bar R. XI, Sec 15 and to carry out the responsibilities set forth in this order of appointment. (RD,BR,NW)
