05/07/2001Order/ProceduralFiled Order. Order Striking Briefs and Imposing Sanctions. On February 28, 2001, appellant filed the opening brief. on March 12,2001, appellant filed an amended opening brief. Neither brief was accompanied by an appendix. On April 27, 2001, we entered an order directing appellant to file an appendix to the opening brief. We direct the clerk of this court to strike appellant's opening brief and amended opening brief. Appellant shall have 15 days form the date of this order to file and serve a corrected opening brief. Every assertion of fact in the corrected opening brief shall be supported by a citation to respondent's two-volume appendix. In the event appellant's corrected opening brief cites to documents not included in respondent's appendix, appellant shall file a supplemental appendix. We vacate our order entered on April 27, 2001. We conclude that the manner in which attorney Coleman has briefed this appeal fails to meet the standards annunciated above and, consequently, that the imposition of sanctions is warranted. Attorney Coleman shall personally pay the sum of $500 to respondent and shall, within 15 days from the date of this order, file with the clerk of this court an affidavit or certificate of payment of the sanction. (Order to attorney Coleman by first class and certified mail.) 01-07609
