05/12/2003Order/ProceduralFiled Order. Denying Request to Stay Briefing. fn1[We note the parties' stipulation reflects confusion respecting the proper procedure for perfecting and briefing any forthcoming appeal from the district court's order denying the motion for a new trial. Because the motion for a new trial was filed after the entry of the written judgment of conviction and the filing of a notice of appeal from that judgment, appellant must filed a timely, separate notice of appeal if he elects to appeal the order denying the motion for a new trial. The appeal from that order would then be docketed and briefed in this court as a separate appellate proceeding. Although one or both of the parties could move to consolidate the two appeals, the court's rules do not contemplate the filing of supplemental briefs in the instant appeal addressing the issues pertaining to the denial of the motion for new trial.] We deny the stipulation and motion to stay the briefing schedule as moot. The State shall have 30 days from the date of this order to file and serve the answering brief. Thereafter, briefing shall proceed in accordance with the schedule set forth in NRAP 31. 03-08003
