10/03/2003Order/ProceduralFiled Order/Briefing Reinstated. When our preliminary review of the docketing statement and the NRAP 3(e) documents revealed a potential jurisdictional defect, we ordered appellant to show cause why this appeal should not be dismissed and directed appellant's counsel to show cause why he should not be sanctioned. In response to our show cause order, appellant's counsel has submitted an amended, fully completed docketing statement, with the required documentation. We decline to sanction appellant's counsel. Because the district court judgment appears to have resolved all of the claims assert4d in the action, including the counterclaim, it was unnecessary to invoke NRCP 54(b). Nevertheless, we conclude that this appeal may proceed, as it is taken from a final, appealable judgment. Appellant Bonicamp shall have 60 days from this order's date to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). 03-16466
