To date, appellant has failed to comply with this court's notice. Appellant shall, within 10 days from the date of this order, file a case appeal statement in the district court and file, with this court, two certified copies of the case appeal statement. We caution counsel for appellant that failure to comply with this order may result in the imposition of sanctions due to the failure to file a case appeal statement, failure to comply with this court's order, and counsel's conduct during the settlement conference proceedings as reported by the settlement judge in reports submitted on November 19, 2002, and November 3, 2003. fn1[Those reports were submitted as letters, however, we have elected to treat them as settlement conference reports. We direct the clerk of this court to file the letter received on November 19, 2002.] The parties were unable to agree to a settlement in this appeal. The settlement proceedings are concluded and this appeal may proceed. Because notice of the judgment's entry was serve by mail on August 16, 2002, Buffman's September 13, 2002 amended notice of appeal was timely, and effectively vested jurisdiction in this court. Accordingly, we deny Goldberger's motion to dismiss. Buffman shall have 15 days from the date of this order to comply with the provisions of NRAP 9(a) and 120 days to file and serve the opening brief and appendix.
