03/31/2003 | Order/Dispositional | Filed Order Dismissing Appeal. fn1[Appellants' motion to remand the appeals in Docket Nos. 37054, 37546 and 37558 is denied as moot. Respondent TRM Corporation's motion for entry of case management orders in those appeals is denied as moot. Harris/Arizona Rebar, Inc.'s motions for extensions of time to file a reply in the appeal under Docket No. 39928 are denied as moot. Harris' motion to dismiss that appeal on the basis that appellants are not aggrieved – the secondary jurisdictional concern mentioned in our show cause order - - is likewise denied as moot. Finally, Harris' request for permission to file a reply in support of the motion to dismiss is denied as moot.] In the three consolidated appeals, Docket Nos. 37054, 37546 and 37558, appellants have moved for a jurisdictional determination. In the fourth appeal, Docket No. 39928, appellants have responded to our jurisdictional order to show cause. We conclude that this court lacks jurisdiction over the consolidated appeals in Docket Nos. 37054, 37546 and 37558, and we, therefore, dismiss these appeals. In response to our show cause order, appellants concede that "NRCP 54(b) certification should not have been entered" and that "this appeal should be dismissed for lack of jurisdiction." We conclude that this court lacks jurisdiction over the appeal in Docket No. 39928, and we, therefore, " . . . dismiss the appeal." NNP03-RR/WM/MG. No. 39928 (Nos. 37054/37546/37558 are consolidated). | | 03-05340 |
04/17/2003 | Motion | Filed Motion. Motion for Leave of Court to File an Amicus Curiae Brief in Support of Petition for Rehearing of the Court's March 31, 2003 Order Dismissing Appeals. No. 39928 and Nos. 37054/37546/37558 (consolidated). | | 03-06581 |

04/21/2003 | Post-Judgment Petition | Filed Petition for Rehearing. Mailed on: 04/18/03. | | 03-06811 |
05/02/2003 | Order/Procedural | Filed Order Denying Motion. Denying Motion as Moot in Docket Nos. 37054, 37546 and 37558. On March 31, 2003, this court entered an order dismissing the four above-captioned appeals. On April 17, 2003, The Associated General Contractors ('AGC') filed a motion for leave to file an amicus curiae brief in support of a petition for rehearing of the order dismissing appeals. Because the caption on AGC's motion included Docket Nos. 37054, 37546, 37558 and 39928, the motion was filed in all four cases. On April 21, 2003, Harris filed its petition for rehearing. A review of the petition reveals, however, that Harris seeks rehearing only of 'that portion of the 'Order Dismissing Appeals' pertaining to Supreme Court Case No 39928.' Accordingly, we deny, as moot, AGC's motion for leave to file an amicus curiae brief in Docket Nos. 37054, 37546 and 37558. The motion remains pending in Docket No. 39928. Nos. 37054/37546/37558 are consolidated. | | 03-07443 |
05/06/2003 | Post-Judgment Order | Filed Order/Rehearing Denied. "Rehearing denied." fn1[NRAP 40(c). The motion filed by The Las Vegas Chapter of the Associated General Contractors for leave to file an amicus brief is denied.] NNP03-RR/WM/MG | | 03-07703 |
