In the fourth appeal, Docket No. 39928, appellants have responded to our jurisdictional order to show cause. We conclude that this court lacks jurisdiction over the consolidated appeals in Docket Nos. 37054, 37546 and 37558, and we, therefore, dismiss these appeals. In response to our show cause order, appellants concede that "NRCP 54(b) certification should not have been entered" and that "this appeal should be dismissed for lack of jurisdiction." We conclude that this court lacks jurisdiction over the appeal in Docket No. 39928, and we, therefore, " . . . dismiss the appeal." NNP03-RR/WM/MG. On March 31, 2003, this court entered an order dismissing the four above-captioned appeals. On April 17, 2003, The Associated General Contractors ('AGC') filed a motion for leave to file an amicus curiae brief in support of a petition for rehearing of the order dismissing appeals. Because the caption on AGC's motion included Docket Nos. 37054, 37546, 37558 and 39928, the motion was filed in all four cases. On April 21, 2003, Harris filed its petition for rehearing. A review of the petition reveals, however, that Harris seeks rehearing only of 'that portion of the 'Order Dismissing Appeals' pertaining to Supreme Court Case No 39928.' Accordingly, we deny, as moot, AGC's motion for leave to file an amicus curiae brief in Docket Nos. 37054, 37546 and 37558. The motion remains pending in Docket No. 39928.
