On August 29, 2003, we granted the petition and reinstated Michael Weisman to practice law. It therefore appears that this matter should now be open to the public. We note, however, that the record contains extensive discussion of a grievance that was never the subject of a formal complaint. Accordingly, we direct Weisman and the state bar to file an answer within thirty days of this order's date, addressing whether this matter should remain confidential, or whether it should be open to the public. On December 8, 2003, we directed Weisman and the state bar to file a response addressing whether this matter should remain confidential, or whether it should be open to the public. On January 16, 2004, Weisman and the state bar filed a joint response asserting that this case should be a matter of public record. We agree, and direct the clerk to remove the confidential designation on the file. fn1[As Justice Leavitt died in office on January 9, 2004, a six-justice court decided this matter.] 04-05590
04/27/2004Order/ProceduralFiled Order. Granting Motion to Modify Reinstatement Conditions. On August 29, 2003, we reinstated Michael Weisman to the practice of law, subject to several conditions. One of the conditions required that Weisman make monthly payments of $1,000 to bar counsel, to be distributed to the recipients designated in our August 29, 2003 order. Weisman has moved to modify this condition to require monthly payments of only $500, effective January 2004. Bar counsel has not opposed the motion. We grant the motion. Weisman shall make monthly payments to bar counsel of at least $500, effective retroactively to January 2004.
