Trial counsel Jonathan E. MacArthur was actually obligated to file the fast track statement. On September 22, 2003, MacArthur informed the district court that, although he would file the notice of appeal, he would not handle the appeal. The district court then appointed Carling as appellate counsel. The district court's order appointing Carling as appellate counsel did not relieve MacArthur of his obligations pursuant to NRAP 3C(b). In the interest of expediting this appeal Carling's motion is granted.
