11/14/2002Order/ProceduralFiled Order/Briefing Reinstated. Reinstate Briefing and Denying Motion to Vacate Judgment Without Prejudice. Having considered Sky Harbor's response to our show cause order, we conclude that the April 14, 2000 decision was the final judgment even though it did not award prejudgment interest. Sky Harbor requests that this court vacate the underlying judgment, dismiss this appeal, and release its $275,000 supersedeas bond funded by its insurer. King Airelines opposes the motion. fn7[We approve the stipulation filed February 7, 2002 and direct the clerk of this court to file the opposition received on February 15, 2002. On February 25, 2002, Sky Harbor moved to file a reply. In light of our order, we deny the motion as moot.] We deny Sky Harbor's motion without prejudice, and we will consider this issue after briefing is completed. We reinstate briefing in this appeal. Sky Harbor shall have 70 days from the date of this order to file and serve the opening brief and appendix. King Airelines shall have 30 days after service of the opening brief in which to file and serve the answering brief. Sky Harbor shall thereafter have 30 days to file and serve any reply brief. fn9[On June 15, 2001, Sky Harbor moved for a stay of this appeal based on its insurance company's rehabilitation. Having reviewed the motion and opposition, we find no basis for a stay and deny the motion.] 02-19596
