12/21/2004Order/ProceduralFiled Order Denying Motion. for Reconsideration. On April 10, 2003, we entered an order dismissing this appeal. On April 24, 2003, this court received appellant's petition for rehearing, which was not accompanied by the required $100 filing fee. Thus, on May 29, 2003, we directed appellant to pay the filing fee within ten days. Appellant did not comply with or respond to this order. Accordingly, on June 25, 2003, we dismissed the rehearing petition as abandoned. On December 11, 2003, this court received two checks, each in the amount of $100, along with a document entitled 'Motion for Reconsideration of the Court's June 25, 2003, Order Dismissing Petition for Rehearing.' fn1[On July 1, 2004, the checks were returned to appellant's counsel.] Attached to the December motion is an affidavit from appellant's counsel. In the affidavit, counsel insists that her law office never intended to abandon the petition for rehearing by failing to pay the filing fee. We conclude that appellant has not demonstrated a sufficient basis for granting the December 2003 motion; thus, we deny it. 04-23289
