Rivlin, Esquire, is in contempt of the Court's order of December 21, 1998, and it is hereby ORDERED that by no later than December 17, 1999, respondent shall produce to Bar Counsel all documents and records in his possession, custody or control that are responsive to the October 27, 1998 subpoena duces tecum -- i.e., copies of all documents and records relating to (1) each and every IOLTA and/or trust account maintained between June 1995 and February 1998, and (2) each and every and every Am-C.A.R. account maintained between June 1995 and February 1998; and it is further ORDERED that on or shortly after December 17, 1999, Bar Counsel shall advise the Court whether respondent has complied with the Court's order by producing copies of all documents and records in his possession, custody or control responsive to Bar Counsel's October 27, 1998 subpoena duces tecum; and it is FURTHER ORDERED that based on this Court's finding of contempt, respondent is sentenced to a period of 90 days incarceration; that sentence shall be stayed until after December 17, 1999 to permit respondent to comply with Bar Counsel's subpoena as stated herein. Rather than producing any documents, respondent sent Bar Counsel a copy of his December 17, 1999 Status Report addressed to the Court stating that he will not be able to produce the documents on December 17, 1999. Bar Counsel respectfully requests that the Court impose the sanction set forth in its Memorandum Order -- incarceration for a period of 90 days -- that was stayed until December 17, 1999 to permit respondent to comply with the subpoena. Given respondents's admission that he has not complied with the subpoena, Bar Counsel submits that a further hearing is unnecessary.
