| 12/15/1992 | | ORDER Record on appeal is remanded to the trial court for more detailed supplemental findings and conclusions of law, which shall address all pertinent issues, including (but not necessarily limited to) the following: 1. the basis for trial court's rejection of Tolson's alleged admission as a statement against the penal interest; 2. the basis for the trial court's finding that Lawson has tried to flim-flam the world not for several years and, specifically, whether this finding was based in whole or in part on past charges against Lawson which did not result in convictions; and 3. the degree, if any, to which the trial judge relied on his belief that Lawson was on probation at the time he was charged with the instant offense. The court views the issue whether appellant is entitled to release pending appeal as a potentially close one. Accordingly, it is suggested that the trial court hold a hearing on the motion and receive evidence, if appropriate. The supplemental fildings and conclusions shall be issued within 30 days of the entry of this order; the order issued on November 10, 1992, is vacated, as the court did not consider the reply filed on November 9, 1992.
