Because we prefer to decide cases on their merits, we grant the petition for rehearing and reinstate this appeal. Appellant shall file in this court a certificate of service indicating that he has properly served each of these documents on respondent. We caution appellant that his failure to comply with this directive may result in the dismissal of his appeal. Respondent shall have 40 days from the date of service of the above documents to file and serve a response, including points and authorities, addressing the issues raised in this appeal and the arguments made in appellant's civil proper person appeal statement.
