06/25/2004Order/ProceduralFiled Order Denying Motion. for Stay and Motion for Child Support. Appellant has filed a motion for stay pending appeal. Respondent has filed a motion for child support pending appeal. In determining whether to grant a stay pending appeal in a child custody matter, this court generally considers four factors. Having reviewed the motion, we are not persuaded that a stay is warranted at this time. Accordingly, we deny appellant's motion. The district court retains jurisdiction to consider respondent's motion for clarification of child support. Accordingly, we deny respondent's motion for child support pending appeal. 04-11694

09/08/2004MotionFiled Stipulation. 04-16469
09/17/2004Order/ProceduralFiled Order Granting Motion. Appellant has filed both an untimely motion and untimely stipualtion for an extension of time to file the opening brief. Nothwithstanding its untimeliness, and cause appearing, the motion is granted. fn1[The stipulation is disapproved as moot.] NRAP 31(a)(2). Appellant shall have until November 2, 2004, to file and serve the opening brief and appendix. On June 11, 2004, appellant filed a transcript request form requesting the production of a transcript by Sunshine Reporting Services. fn2[A copy of the transcript request form is attached to this order.] To date, Sunshine Reporting Services has not filed the requested transcript with this court. We elect to waive the requirements of NRAP 30(b)(1) and allow appellant to include the transcript for proceedings held on January 5, 2004, in the appendix. Therefore, Sunshine Reporting Services is not obligated to file the requested transcript with this court. fn3[We remind Sunshine Reporting Services that NRAP 9(b) requires a court reporter/recorder to file with this court a certificate acknowledging delivery of the completed transcript, together with a certified copy of the completed transcript.] 04-17193

02/25/2005Order/ProceduralFiled Order/Stipulation Disapproved. On January 19, 2005, the parties filed a stipulation extending the time for respondent to file the answering brief. We note that pursuant to this court's order entered on December 3, 2004, the answering brief was due on January 5, 2005 – 20 days from service of appellant's opening brief. The stipulation is therefore untimely. Further, because this appeal is from an order affecting the custody of minor children, an extension of time by stipulation is not permissible. NRAP 31(a)(2). Accordingly, we disapprove the stipulation. Respondent shall have 10 days from the date of this order to file and serve the answering brief. 05-03822
