05/10/2005 | Order/Procedural | Filed Order Denying Motion. On March 10, 2005, a panel of this court consisting of Justices Maupin, Douglas and Parraguirre entered an order of affirmance in appellant Felton Matthews' criminal appeal in Docket No. 43822. On March 4, 2005, the same panel of justices entered an order denying Matthew's criminal petition for extraordinary injunctive relief in Docket No. 44626. On March 22, 2005, Matthews submitted to this court a proper person motion to disqualify Justices Parraguirre and Maupin from participating in these matters. We conclude that the motion fails to establish a legitimate disqualifying interest on the part of either Justice Maupin or Justice Parraguirre in the above-entitled criminal matters. Accordingly, the motion is denied. fn1[To the extent that Matthews was seeking to disqualify Justices Parraguirre and Maupin from participating in Docket No. 42339, a civil appeal, the request is moot as both Justices Parraguirre and Maupin have recused themselves from participating in the appeal in Docket No. 42339.] Nos. 43822/44626 – cases are not consolidated. | 05-09171 |
