This is an appeal from an order of the district court denying a motion to correct an illegal sentence. Appellant has filed emergency motions seeking: (1) a stay pending appeal of execution of a sentence imposed in an amended judgment of conviction; (2) an order directing the department of corrections to immediately release appellant from custody; and (3) an order expediting this appeal. We grant the relief requested in part. We hereby stay the execution of appellant's sentence pending the resolution of this appeal, and we expressly direct the department of corrections to immediately release appellant from any form of custody, including residential confinement, upon appellant's presentment of proof that she posted the $100 cash bail as previously ordered by the district court. We grant, in part, appellant's motion to expedite this appeal. Appellant shall have 15 days from the date of this order within which to file and serve a fast track statement and an appendix in accordance with the provisions of NRAP 3c. Fn1[we hereby direct the district court enter a written order resolving appellant's motion to correct an illegal sentence within 10 days of the date of this order. Upon entry of that order, the clerk of the district court shall immediately transmit a certified copy of that order to the clerk of this court.] Thereafter, the state shall have 15 days from the date of service of appellant's fast track statement within which to file a fast track response. No extensions of time will be granted absent extreme and unusual circumstances. Upon the filing of the fast track response, this court will expedite its consideration of the appeal.
