On the morning of April 23, 2003, appellants filed a motion for a 30-day extension of time to file the opening brief in this appeal. That same morning, appellants' motion was granted. On the afternoon of April 23, 2003, respondent filed an opposition to appellants' motion. We elect to treat the opposition as a motion for reconsideration of this court's order granting the extension. Because we conclude that appellants demonstrated good cause for the extension, we deny respondent's motion for reconsideration and request to dismiss this appeal. On June 6, 2003, respondent filed a 'Motion to Strike Opening Brief of Appellant and for Other Relief.' Respondent alternatively requests this court to 'deny the Appellants the opportunity to file a Reply Brief to include additional citations to the Record,' impose sanctions against appellants, direct appellants to obtain a copy of the December 17, 2001, trial transcript, extend the period for filing the answering brief and grant respondent permission to file an answering brief of up to 50 pages. Appellants oppose the motion. Appellants' counsel has submitted an amended opening brief that is 42 pages in length and contains a corrected table of authorities. Appellants request this court to deny the motion to strike, or alternatively, to grant them permission to file the amended opening brief. Because appellants concede that the opening brief received on May 23, 2003, contains an incorrect table of authorities and because appellants have submitted an amended opening brief that corrects this deficiency, we grant respondent's motion to the extent that it requests this court to strike the opening brief received on May 23, 2003. All other relief requested in respondent's June 4, 2003, motion is denied. The clerk of this court shall return, unfiled, the opening brief received on May 23, 2003. Further, we grant appellants' request to file their 42-page amended opening brief. The clerk of this court shall file the amended opening brief received on June 16, 2003, and the appendix received on May 27, 2003. On June 18, 2003, respondent filed a motion for leave to file an answering brief in excess of 30 pages. Cause appearing we grant the motion. The clerk of this court shall file the answering brief received on June 26, 2003. Appellants shall have 30 days from the date of this order to file and serve a reply brief, if deemed necessary. It appears that the December 17, 2001, transcript cannot be produced. Accordingly, if either party intends to rely on testimony presented at the December 17, 2001, proceeding, the parties shall prepare a statement of the evidence or proceedings in compliance with NRAP 9(d). If the parties will be preparing such a statement, they shall so notify this court within 15 days from the date of this order. On June 18, 2003, respondent filed a motion requesting the transmission of original exhibits pursuant to NRAP 30(d). Respondent specifically requests the transmission of 'District Court Exhibit #28, 'Day in the Life Film' of Robert Stuart [3 Videotapes]' and 'District Court Exhibit #14, 'Robert Stuart Residence' [1 Videotape – 11 minutes. Appellants oppose the motion to transmit the original exhibits. Because it appears that the review of the original exhibits may assist this court in reviewing this issue, we grant the motion to transmit original exhibits. The district court clerk shall, within 30 days from the date of this order, certify and transmit the original exhibits identified above that were filed in district case number A430317.
