Appellant's remedy, if any, is to assert his factual allegations respecting the timely filing of the notice of appeal to the district court in a post-conviction petition for a writ of habeas corpus. If appellant's petition demonstrates that he was deprived of a direct appeal by impediments beyond his control, the district court may permit appellant, with the assistance of counsel, to raise any direct appeal issues in the post-conviction petition in accordance with this court's decision in Lozada v.
