Appellant's remedy, if any, is to assert his factual allegations respecting the timely filing of the notice of appeal to the district court in a post-conviction petition for a writ of habeas corpus. If appellant's petition demonstrates that he was deprived of a direct appeal by impediments beyond his control, the district court may permit appellant, with the assistance of counsel, to raise any direct appeal issues in the post-conviction petition in accordance with this court's decision in Lozada v. State. Appellant may then appeal any adverse decision of the district court to this court. Accordingly, we deny appellant's proper person motion to "re-open" this appeal. 03-13623
