03/29/2004Order/ProceduralFiled Order Denying Motion. On February 26, 2004, Gorden & Silver, Ltd., through attorney Eric R. Olsen, filed a motion to withdraw as counsel of record for appellant. On March 8, 2004, this court entered an order deferring ruling on the motion pending the completion of oral argument. Oral argument of this appeal was held on March 10, 2004. On March 18, 2004, appellant, through Paul E. Pennington, President of Goodrich & Pennington Mortgage Fund, Inc., filed a proper person letter in opposition to the motion to withdraw. fn1[Although Mr. Pennington's letter was filed and we considered his letter in our resolution of this matter, we decline to grant Mr. Pennington permission to file any additional proper person documents in this appeal. See NRAP 46(b).] In opposition to the motion, Mr. Pennington represents that he has 'paid more than the original estimate' and has requested Gordon & Silver to participate 'in a fee arbitration through the Nevada State Bar Association' to resolve the dispute. Based on the representations made by Mr. Olsen and Mr. Pennington, this court is unable to conclude whether Mr. Pennington has failed to fulfill his obligations to Gordon & Silver. See SCR 166(2)(d) and (e). Therefore, we deny Gordon & Silver's motion to withdraw. We note, however, that oral argument for this appeal was recently held and the appeal was submitted for decision and that an attorney may withdraw at any time 'after judgment or final determination.' See SCR 46. Accordingly, this denial is without prejudice to Gordon & Silver's right to withdraw upon entry of a final determination resolving this appeal. 04-05800
