In determining whether to grant a stay pending appeal, this court considers four factors. We conclude that these factors militate in favor of a stay. Additionally, nothing in NRAP 8 or NRCP 62 requires this court to condition a stay pending appeal on the posting of a bond in all cases. Having considered the motion and opposition we conclude that no bond shall be required of appellants at this time. If, while this appeal is pending, the parties' positions change so that some security should be provided as a condition for continuing the stay, then respondent may bring an appropriate motion. 05-01330
