As these appeals arise from the same facts and district court proceedings, we conclude that consolidation will further judicial administrative interests. These appeals, Docket No. 42486 and Docket No. 42819, are consolidated. This court also vacates the notice of settlement conference in each of these cases and removes these matters from the settlement conference program. We further conclude that briefing is warranted on an expedited basis in these consolidated appeals. Appellants shall have 60 days from the date of this order to file the opening brief and appendix. Respondent shall have 30 days from the date appellants' brief is served to file and serve the answering brief. The reply brief, if any, shall be filed and served within 10 days of the date that respondent's answering brief is served. Extensions of this briefing schedule shall be permitted only upon demonstration of extreme need or merit.
