03/19/2001MotionFiled Response to Order to Show Cause. Appellant's Response to Order to Show Cause and Supplement to Docketing Statement. 01-04828
10/12/2001Order/ProceduralFiled Order. Allowing Appeal to Proceed. In response to our order to show cause filed March 7, 2001, appellant has submitted a copy of a stipulation of dismissal, filed with the district court on February 9, 1999. In light of the documents presently before this court, we cannot conclusively discern whether the stipulation is deficient because it is not "signed by all parties who have appeared in the action." The February 1, 1999 order granting summary judgment in favor of respondent, and against appellant, contains an effective NRCP 54(b) certification. Thus, the December 10, 1999 order awarding attorney fees and costs, which has been appealed from, is properly construed as a special order made after final judgment. Counsel's failure to fully and accurately complete the docketing statement has wasted the limited resources of this court and needlessly delayed resolution of this appeal. While we elect not to impose sanctions on appellant's counsel, we caution counsel to exercise greater care in completing this court's docketing statement in future appeals. 01-17219
