12/20/1999Order/CounselFiled Order/Sanctions. We conclude that Respondent/Cross-Appellant WaterPur, and specifically Amyn Dahya, failed to participate in good faith in the settlement conference. We conclude that the imposition of sanctions against Mr. Amyn Dahya is appropriate. Mr. Dahya shall personally pay Print Consultants $1,500.00 for costs incurred by Print Consultants in attending the scheduled settlement conference. In addition, Mr Dahya shall pay $1,000.00 to the Supreme Court Law Library. WaterPur shall separately file with this court, within 30 days from the date of this order, proof of payments of the sanctions. Failure to timely comply with this order will likely result in the imposition of additional sanctions, including dismissal of WaterPur's cross-appeal. We deny WaterPur's request for an additional settlement conference. We defer ruling on Print Consultants' conditional motion to dismiss its own appeal and direct the clerk to return, unfiled, Print Consultants' "Reply to Response to the Order to Show Cause" received on April 23, 1999. This appeal shall forthwith proceed as no settlement has been reached. Appellant/Cross-Respondent shall have 15 days from the date of this order to comply with NRAP 9(a) and 120 days to file and serve the opening brief. Briefing shall proceed in accordance with NRAP 31 (a)(1).
